Tai Ping Membership Terms and Conditions
Membership of the Tai Ping programme is free.
Only individuals may be members. Any individual who wishes to become a member must agree to be bound by these Terms and Conditions, as varied from time to time.
Members will be issued with a membership card. Tai Ping may charge $5.00 for a replacement card.
Tai Ping may terminate a membership of the Tai Ping programme, without notice and for any reason if the menber
* fails to comply with these Terms and Conditions; or
* supplies any misleading information or makes any misrepresentations to Tai Ping or to any participating company in connection with the Tai Ping programme; or
* abuses any privilege accorded to the member under the Tai Ping programme; or
* does not use his or her membership card for a period of 12 months; or
* dies or becomes bankrupt.
A member may at any time terminate his or her membership or cancel a secondary card by giving written notice to Tai Ping. Any tax such as GST, FBT or otherwise arising from a member's participation in the Tai Ping programme is the responsibility of the member.
Points will be recorded in a member's points record for purchases by the member, of qualifying goods or services from a participating company. Points may also be recorded in a member's points record in relation to promotional and incentive programmes.
Tai Ping and the participating companies in their own absolute discretion will from time to time determine which goods or services are qualifying goods and services and the number of points that will be recorded in a member's points record for such purchases.
A member must, in order to receive points, notify the participating retailer before the transaction is concluded that the transaction is a Tai Ping transaction. This may be done by presenting the relevant membership card or secondary card or, if the purchase is by telephone or mail order or by e-dealing, by quoting the membership number to which the card relates. This also applies to purchases made using participating credit cards that have been linked to a Tai Ping membership.
Points will be recorded in the member's points record only after the participating company has notified Tai Ping of the details of the relevant transaction.
Points collected by a credit card will be recorded at the time of processing the next credit card statement.
Tai Ping will, from time to time post a Points Summary on each members secured account setting out the opening points balance, points recorded and deducted during the period and the closing points balance, The Points Summay will be available to the member by online access using secure login
Disputes about the Points Summary must be notified to Tai Ping by the date specified in the relevant Points Summary. The Points Summary will otherwise be taken to be correct and binding on the member. Tai Ping’s decision on any such dispute is final and binding.
Tai Ping will not record points given by companies after they have ceased to be participants in the Tai Ping programme.
A member who has recorded sufficient points in his or her points record may request a reward from the then current reward schedule. Requests must be made by the member personally and not by an agent or secondary card holder. All rewards are subject to availability. Rewards will be posted or delivered, at Tai Ping’s option, to the current address of the member shown in Tai Ping’s records.
If a member’s card is lost or stolen and Tai Ping agrees to replace a lost or stolen card, the member shall comply with such conditions as Tai Ping imposes.
All rewards are subject to such other terms and conditions as are mentioned in the then current reward schedule or in any other terms and conditions relating to the reward, determined by the reward provider including any ticket for airline travel. It is the member's responsibility to satisfy any terms and conditions imposed by an airline or other reward provider including advance booking requirements and any restrictions on and/or fees payable in respect of the cancellation or alteration of tickets. A Tai Ping certificate as to a member's entitlement to claim a reward shall be conclusive in the absence of manifest error.
The number of points set out in the then current reward schedule for a reward claimed will be deducted from the balance then in the member’s Points Summary, with the oldest points being deducted first. Tai Ping may also deduct from the points balance in a member's Points Summary:
* any points recorded in error; and
* any points relating to a transaction which is cancelled or where a refund is given; and
* any points which are not used by a member to claim a reward within 36 months after the end of the month in which the points were recorded. These will expire and be deducted from the points balance in a member's points record.
Information about members and (whether provided by members directly to Tai Ping, or by participating companies and/or reward providers about member transactions) will be collected by Tai Ping and held at Tai Ping’s Head Office. This information will be used by Tai Ping, and its agents, to provide services relating to the Tai Ping programme including to provide a telephone service centre, membership and secondary cards, Point Summaries and market research. Information from the database will also be used by Tai Ping for marketing purposes, planning, product development and research. A Member may access information about themselves but not about other members by producing photo identification and attending Tai Ping Head office to request their information.
Each member consents to the collection and use of their personal and other information in the manner set out above and the disclosure of such information to Tai Ping's agents and reward providers for the purposes of operating the Tai Ping programme. Information about members and may be disclosed to a participating company if:
* the member consents in writing such consent being given by the member in his or her application for membership or;
* Tai Ping considers on reasonable grounds that that disclosure is necessary to enable the recording of points in relation to transactions of those members; or
* Tai Ping considers on reasonable grounds that the member may have been involved in fraudulent activities in relation to that participating company.
Information about members and will not be provided by Tai Ping to any person except as provided in this Section 5.
Members have the right to opt out of communication by post or email by giving written notice to Tai Ping; and pursuant to the Unsolicited Electronic Messages Act 2007, each email shall have the option that the member may decline to receive further emails.
Members and may, under the provisions of the Privacy Act 1993, request access to and correction of their personal information held by Tai Ping. These requests must be in writing. A fee may be charged for the reasonable costs incurred in responding to these requests. Any such fee will be disclosed to the member before it is incurred.
Membership cards and secondary cards are not transferable and are the property of Tai Ping.
Points, and any rights they confer, cannot be sold, transferred, assigned or otherwise dealt with except in accordance with these Terms and Conditions. Points have no cash or monetary value.
Tai Ping may change, at any time and without prior notice, these Terms and Conditions, the reward schedule and/or the participating companies. Tai Ping may make that change even if it has the effect of reducing or extinguishing the number or value of, or the period for expiry of, any existing or future points. Tai Ping will attempt to notify members of any changes.
Tai Ping may also change, at any time and without prior notice, the goods and services which are qualifying goods and services and/or the number of points which members will receive for purchasing such goods and services.
Tai Ping reserves the right to suspend or terminate the Tai Ping programme at any time without prior notice.
Tai Ping is not liable for:
* any delay in replacing a membership card or for any unauthorised use of a membership or secondary card;
* for any failure of a member to notify a participating company that a transaction is a Tai Ping transaction;
* any delay by or failure of a participating company to notify Tai Ping of the details of a transaction;
* any loss, theft or damage to any reward in the course of post or delivery;
* any reward not being available for any reason;
* any failure by the reward provider to meet the terms and conditions on which it has agreed to provide a reward;
* any failure to notify members of any changes in these Terms and Conditions, the reward schedule, participating companies, qualifying goods and services and/or the number of points which will be recorded for the purchase of qualifying goods and services;
* the suspension and/or termination of the Tai Ping programme.
All conditions and warranties, whether express or implied and whether arising under legislation or otherwise, as to the condition, suitability, quality, fitness or safety of any goods or services supplied under the Tai Ping programme are expressly excluded to the full extent permitted by law.
Any liability Tai Ping may have to a member under legislation in respect of such goods and services which cannot be excluded is limited, where permitted, to supplying, or paying the cost of supplying, the goods or services again or repairing, or paying the costs of repairing, the goods, at Tai Ping option.
Tai Ping provides the Tai Ping programme for participating companies and each exclusion or limitation of liability in these Terms and Conditions also applies to each of those participating companies and their employees and agents.
Participating companies do not have any authority, express or implied, to make any representation, warranty or statement on behalf of Tai Ping.
A notice shall be deemed to be given by Tai Ping to a member if it is posted to the address of the member appearing in the Tai Ping records or sent to an email address which has not been declined or blocked by the member.
In these Terms and Conditions 'Tai Ping' means Tai Ping Trading City Limited, Tai Ping Trading Northcote Limited, Tai Ping Trading 2003 Limited, and Beach Road Liquor Limited and 'Tai Ping programme' means those arrangements by which a member receives points by purchasing qualifying goods and services from participating companies and so qualifies for rewards under these Terms and Conditions. References to 'participating companies' are to those companies (and other persons) who supply qualifying goods and services in respect of which points will be credited under the Tai Ping programme.
1. Issuing Your Gift Card
1.1 The Gift Card can be purchased from a range of participating companies. For a list of places where you can purchase your Gift Card, visit www.taiping8.co.nz.
1.2 You can nominate the value of your Gift Card at the time of purchase for any amount between $10 and $1,000.
1.3 The participating company issuing your Gift Card will activate the Gift Card after you have paid the value you have nominated for it and will record the value of your Gift Card on the Gift Card carrier. The Gift Card cannot be used until it has been activated.
1.4 You can also purchase your Gift Card on-line from Tai Ping’s website www.taiping8.co.nz. and following the instructions.
1.5 If you have purchased your Gift Card on-line:
(a) Tai Ping will activate your Gift Card and will send the activated Gift Card to the person at the physical address in New Zealand nominated by you in your on-line application; and
(b) you will pay the purchase price of the Gift Card plus the cost of postage/courier handling.
1.6 You agree to be bound by these terms and conditions. A Holder receives the Gift Card subject to these terms and conditions.
2.1 The Gift Card can only be used to purchase goods and/or services at participating companies who redeem the Gift Cards at that time. For a current list of places where you can redeem your Gift Card, visit www.taiping8.co.nz.
2.2 Please note that the participating companies who redeem Gift Cards will change from time to time.
2.3 Use the Gift Card in full or part payment for goods and services. Follow the instructions given to you by the participating company to redeem the Gift Card. The amount of your redemption will be deducted from the value of the Gift Card. The total value of redemptions cannot exceed the total value of the Gift Card.
2.4 You can check the remaining balance on your Gift Card. See Tai Ping’s website, www.taiping8.co.nz for more details. Please note that there is a delay between the time you make a redemption and the time that redemption is reflected in the Gift Card balance shown. As a result, the balance shown will not necessarily include all the redemptions you have made before your balance enquiry. You agree that notwithstanding what the Gift Card balance is shown as, you are not be entitled to redeem the Gift Card for more than:
(a) the total nominated value of the Gift Card; or
(b) the actual remaining balance of the Gift Card.
2.5 The same Gift Card can be used at more than one participating company.
2.6 The Gift Card expires one year after it is activated. Any unused value remaining on the Gift Card on its expiry is not refundable.
2.7 The Gift Card cannot be redeemed or refunded for cash. Change will not be given for the unused balance of the Gift Card.
2.8 A Gift Card that has been worn, altered, or damaged in any way will not be redeemed, replaced or refunded.
2.9 Treat the Gift Card like cash. A lost or stolen Gift Card will not be replaced or refunded.
2.10 A Gift Card cannot be used to purchase another Gift Card.
3.1 The Gift Card remains Tai Ping’s property at all times.
3.2 Neither a participating company nor Tai Ping are required to carry out any of the obligations referred to in these terms and conditions if it is not reasonably practical for Tai Ping or the participating company to do so because of an event outside Tai Ping’s control or the control of the participating company.
3.3 To the maximum extent permitted by law, the participating companies’ liability and Tai Ping’s liability to you and the Holder is, in all circumstances, limited to the redemption of the total value of the Gift Card. Neither the participating companies nor Tai Ping are liable to any person for any loss, cost, claim, liability or delay whether direct (including loss of profits) or indirect, consequential or special and whether due to negligence, breach of contract, breach of any other obligation owed to you by Tai Ping or by a participating company or for any other reason, except as otherwise provided by statute (including the Consumer Guarantees Act 1993).
3.4 Neither Tai Ping nor any participating company will be liable to you or the Holder for any loss suffered as a result of the loss of theft of the Gift Card purchased on-line and posted or couriered to the physical address in New Zealand nominated by you in your on-line application.
3.5 You will indemnify Tai Ping and any relevant participating company against any loss, damage, cost, claim or liability incurred by Tai Ping or the participating company:
(a) arising from any breach by you or the Holder of these terms and conditions; or
(b) in respect of the Holder in connection with the Gift Card beyond Tai Ping’s obligation, and the obligation of the participating company, to redeem the Gift Card.
3.6 Clauses 3.3, 3.4 3.5 and this 3.6 survive the redemption or expiry of the Gift Card
3.7 You may not assign any of your rights or obligations under these terms and conditions without Tai Ping’s consent. Tai Ping may assign any of its rights and obligations under these terms and conditions to any person nominated by Tai Ping to operate the Gift Card.
3.8 These terms and conditions constitute the entire agreement between you and the Holder, on the one hand, and the participating companies and Tai Ping, on the other, in respect of the Gift Card.
3.9 Tai Ping may vary these terms and conditions at any time by placing a notice on its website advising that these terms and conditions have changed.
3.10 Tai Ping may cancel a Gift Card at its discretion if you, or the Holder, breaches any of these terms and conditions.
3.11 For the purposes of the Contracts (Privity) Act 1982, where the Holder is a third person, these terms and conditions are not intended to create an obligation, or any other rights, enforceable by the Holder against Tai Ping or the participating companies.
3.12 Information collected by Tai Ping about you or the Holder (as the case may be) may be “personal information” for the purposes of the Privacy Act 1993. You and the Holder both agree to the collection and use of this personal information and the disclosure of such information to Tai Ping’s agents for the purposes of operating and marketing Gift Cards and the Tai Ping Programme.
3.13 Information can be disclosed to the participating companies if:
(a) you consent in writing; or
(b) Tai Ping considers that disclosure is necessary to enable a Gift Card to be issued, redeemed, or otherwise processed, or to enable Tai Ping or the participating company to comply with its obligations under these terms and conditions; or
(c) Tai Ping considers that you or the Holder may have been involved in fraudulent activities in relation to a participating company, in which case Tai Ping may also cancel the Gift Card at its discretion.
3.14 You agree that Tai Ping can disclose your personal information to the Holder. You have the right to request access to, and correction of, this personal information. For any enquiries, please log in to Tai Ping’s website www.taiping8.co.nz, and email Tai Ping directly.
3.15 If you purchase a Gift Card for the purpose of your business, the Consumer Guarantees Act 1993 will not apply to the supply and redemption of the Gift Card.
3.16 For the purposes of the Goods and Services Tax Act 1985, the Gift Card and the attached Gift Card carrier together comprise a single voucher, the face value of which is the amount recorded on the Gift Card carrier at the time that the participating company issues the Gift Card to you.
4.1 In these terms and conditions, unless the context otherwise requires:.
(a) words importing the singular include the plural and vice-versa; and
(b) references to any legislation or document include all modifications, amendments and variations from time to time.
(a) a reference to “$” refers to the amount in the lawful currency of New Zealand.
4.2 In these terms and conditions, unless the context otherwise requires:
event outside Tai Ping’s control means any event beyond Tai Ping’s, or a participating company’s, reasonable control, including without limitation, natural disasters, loss of telecommunications or other utilities, and any other disruption which affects Tai Ping’s ability, or a participating company’s ability, to discharge the obligations owed to you;
Holder means any person in possession of the Gift Card at the relevant time;
Tai Ping means Tai Ping Limited (together with its successors and permitted assigns), and, for the purposes of these terms and conditions, includes any other person engaged by Tai Ping Limited in connection with the supply of Gift Cards;
participating company or participating companies means those companies that, for the time being, issue and/or redeem the Gift Cards, as the case may be. For a current list of the Gift Card participating companies, see www.taiping8.co.nz. Please note that the participating companies who issue/redeem Gift Cards will change from time to time; and
you or yourself means any person to whom Tai Ping, or a participating company, has supplied a Gift Card under these terms and conditions, and, where the context requires, means any of those persons jointly and severally, and your has a corresponding meaning.
5. Corporate Gift Card from Tai Ping
5.1 The minimum order quantity for the Corporate Gift Card from Tai Ping is 100 cards (and in increments of 100 cards), we can discuss customising your order to suit your requirements.
5.2 All Gift Cards from Tai Ping feature a scratch panel Access PIN on the back of the card. The PIN is used to: (1) access the internet and telephone card management services, and (2) make purchases in-store.
5.3 Lost or stolen Gift Cards can be replaced up till the time they are activated. All you need is proof of purchase. Once activated, lost or stolen cards cannot be replaced or refunded.
5.4 Each Corporate Gift Card order must be made up of cards that are the same design, dollar value, and delivery address.
5.5 Payment is required for the Gift Cards by direct debit prior to Tai Ping processing any order.
5.6 Corporate Gift Cards are delivered via courier to a single delivery address. After the cards are delivered, it is the recipient's responsibility to ensure they are activated and distributed appropriately. This is a simple process that our team will guide you through when your order is placed.
5.7 As a security measure, Corporate Gift Cards are sent to the intended recipient 'inactive', i.e. they cannot be used until the recipient activates them using our telephone activation service. This is a simple process that our team will guide you through when your order is placed.
